About this policy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Quirky NZ Limited, trading as Quirky Campers NZ (&#8220;Quirky&#8221;, &#8220;we&#8221;, &#8220;us&#8221;, &#8220;our&#8221;), runs a peer to peer campervan hire platform. We connect owners of handcrafted campervans with people who want to hire them, and we act as agent for those owners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This policy explains what personal information we collect, why, who we share it with, how long we keep it, and your rights over it. It applies to www.quirkycampers.com\/nz, to enquiries and bookings made by email, phone or social media, to hires arranged through us, and to our dealings with campervan owners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We are an agency under the Privacy Act 2020 and we handle personal information in line with the information privacy principles in that Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our General Manager is our privacy officer and can be contacted at <a href=\"mailto:marketing@quirkycampers.com\">marketing@quirkycampers.com<\/a>, or by post at Level 14, 88 Shortland Street, Auckland 1010.<\/p>\n\n\n\n<h2 id=\"who-this-policy-covers\" class=\"wp-block-heading\">2. Who this policy covers<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Customers who enquire about, book or hire a campervan, and every named driver on a booking<\/li>\n\n\n\n<li>Other members of a travelling party whose details are given to us by the person booking<\/li>\n\n\n\n<li>Campervan owners who list with us, and owners who apply to list<\/li>\n\n\n\n<li>People who visit our website, message us on social media, or subscribe to our mailing list<\/li>\n\n\n\n<li>Anyone whose details reach us as part of an incident, insurance claim or dispute<\/li>\n<\/ul>\n\n\n\n<h2 id=\"what-we-collect\" class=\"wp-block-heading\">3. How we collect it<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Most information comes directly from you, through our website forms, by email or phone, when you subscribe to our mailing list, and at handover when the owner checks your licence and proof of address on our behalf.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We also collect information about you from other people and organisations, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The campervan owner, who takes copies of licences and proof of address on our behalf and reports back on how the hire went<\/li>\n\n\n\n<li>The person who made the booking, where they give us details for additional drivers or other travellers<\/li>\n\n\n\n<li>Sentry Tracking Solutions, our GPS provider<\/li>\n\n\n\n<li>Our payment providers and bank, including failed payment and chargeback information<\/li>\n\n\n\n<li>Our insurance broker, insurer, loss adjusters, repairers, roadside assistance providers and others involved in an incident or claim<\/li>\n\n\n\n<li>Waka Kotahi NZ Transport Agency, road controlling authorities, councils and NZ Police, including infringement notices and licence checks<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where we collect information about you from someone else, we take reasonable steps to make sure you know we hold it, what we are using it for, who we may give it to, and how to access and correct it, unless the Privacy Act allows otherwise. That includes situations where you already know, where telling you would prejudice an insurance investigation, the maintenance of the law or the safety of any person, or where it is not reasonably practicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you book for other people, please tell them their details are being given to us and point them to this policy.<\/p>\n\n\n\n<h2 id=\"why-we-use-it\" class=\"wp-block-heading\">5. Why we use it<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To answer enquiries, provide quotes and help you choose a van<\/li>\n\n\n\n<li>To take, confirm and administer bookings, and keep you updated before and during your trip<\/li>\n\n\n\n<li>To check that every driver is legally entitled to drive in New Zealand and meets our insurer&#8217;s criteria<\/li>\n\n\n\n<li>To give your details to the owner of the van you have booked, so they can arrange handover and support you<\/li>\n\n\n\n<li>To take payment, hold and release security deposits, charge road user charges, issue refunds and recover money owed<\/li>\n\n\n\n<li>To provide breakdown cover and roadside assistance, and to support you when something goes wrong<\/li>\n\n\n\n<li>To protect the vans from theft, respond to emergencies, and enforce the road and use restrictions in our Booking Conditions<\/li>\n\n\n\n<li>To manage insurance claims, damage assessments, infringements and disputes<\/li>\n\n\n\n<li>To onboard and pay owners, and to meet our obligations under our Transport Service Licence and other law<\/li>\n\n\n\n<li>To send service messages about a live booking, and marketing only where you have asked for it<\/li>\n\n\n\n<li>To understand demand, pricing and fleet utilisation, using aggregated figures that do not identify you<\/li>\n\n\n\n<li>To publish reviews, photographs or owner stories, where you have given permission<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We will not use your information for another purpose unless it is directly related to one of the above, you have authorised it, or the Privacy Act allows it.<\/p>\n\n\n\n<h2 id=\"gps-tracking\" class=\"wp-block-heading\">6. GPS tracking<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Every campervan on our platform is fitted with a GPS tracker. While a van is on hire the tracker records its location, speed, direction, movement and the times of each, and generates alerts for harsh braking, acceleration or cornering, for speeding, and when a van enters an area we have flagged, such as a forbidden unsealed road.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We use this to locate a van if it is stolen or if you need emergency help, to investigate accidents and insurance claims, to enforce the road and use restrictions in our Booking Conditions, and to support owners in caring for their vehicles. We do not use GPS data for marketing and we do not sell it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GPS data may be shared with the owner of the van, our insurer and broker, loss adjusters, and NZ Police or other authorities investigating theft or an offence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The data is collected and held on our behalf by Sentry Tracking Solutions Limited, a New Zealand company, and is handled in accordance with their privacy terms, available at <a href=\"https:\/\/sentrytrackingsolutions.co.nz\/\" target=\"_blank\" rel=\"noreferrer noopener\">sentrytrackingsolutions.co.nz<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">GPS tracking is also covered in our <a href=\"https:\/\/www.quirkycampers.com\/nz\/booking-conditions\/\">Booking Conditions<\/a>. Nothing in those conditions removes your rights under the Privacy Act.<\/p>\n\n\n\n<h2 id=\"who-we-share-it-with\" class=\"wp-block-heading\">7. Who we share it with<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We share personal information only where it is needed for one of the purposes in section 5. We do not sell personal information and we do not rent or trade mailing lists.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><th>Who<\/th><th>What they receive and why<\/th><\/tr><\/thead><tbody><tr><td>The campervan owner<\/td><td>Your name, contact details, driver details and booking details, so they can contact you, hand over the van and support you during the hire. Owners are required to comply with the Privacy Act and to use your details only for your booking<\/td><\/tr><tr><td>Our insurer and broker<\/td><td>Driver and incident details for cover, eligibility checks and claims. Currently Vero, through Arthur J Gallagher (NZ) Limited<\/td><\/tr><tr><td>Loss adjusters, assessors, repairers and recovery agents<\/td><td>Incident, vehicle and contact details needed to assess and settle a claim<\/td><\/tr><tr><td>Breakdown and roadside assistance providers<\/td><td>Your name, contact details and location, so they can reach you<\/td><\/tr><tr><td>Payment providers and our bank<\/td><td>Payment details, processed on their systems. Access is limited to what is needed and is subject to that company&#8217;s privacy policy and UK data protection law<\/td><\/tr><tr><td>Authorities and regulators<\/td><td>NZ Police, Waka Kotahi, councils, courts and other bodies where required or permitted by law, including driver details for infringements incurred during your hire<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"sending-information-overseas\" class=\"wp-block-heading\">8. Sending information overseas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some of the organisations above are based outside New Zealand, or store information on servers outside New Zealand, including in the United States, Australia, the United Kingdom and Europe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before disclosing personal information overseas we make sure that at least one of the following applies: the recipient is subject to privacy laws providing comparable safeguards to the Privacy Act, the recipient is contractually required to protect the information to a comparable standard, or you have expressly authorised the disclosure after we have told you that comparable safeguards may not apply.<\/p>\n\n\n\n<h2 id=\"marketing\" class=\"wp-block-heading\">9. Marketing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We send marketing emails only to people who have asked to receive them. Every marketing email includes an unsubscribe link and we act on unsubscribes straight away. You can also email us to be removed. This is consistent with the Unsolicited Electronic Messages Act 2007.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Messages about a booking you have already made, such as payment reminders and pre trip information, are service messages rather than marketing, and we will continue to send those while your booking is live.<\/p>\n\n\n\n<h2 id=\"cookies\" class=\"wp-block-heading\">10. Cookies<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A cookie is a small file placed on your device when you visit our website. We use basic traffic log cookies to identify which pages are being used. This helps us analyse web page traffic and improve the site, and we use the information for statistical purposes only.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cookies do not give us access to your device or to any information about you other than the data you choose to share with us. Most browsers accept cookies automatically, but you can change your browser settings to decline them. This may stop parts of the site working properly.<\/p>\n\n\n\n<h2 id=\"storage-security-and-retention\" class=\"wp-block-heading\">11. Storage, security and retention<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your information is held in secure systems operated by us and by the providers listed above, with access limited to the people who need it. Email is not encrypted in transit, so please do not send card numbers or other sensitive details by email. Privacy breaches<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If we have a privacy breach that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and the people affected as soon as we practicably can, as required by the Privacy Act 2020. We will tell you what happened, what information was involved, and what you can do about it.<\/p>\n\n\n\n<h2 id=\"access-and-correction\" class=\"wp-block-heading\">13. Access and correction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You have the right to ask for a copy of the personal information we hold about you, and to ask us to correct it if it is wrong. There is no charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We will respond as soon as we can and within 20 working days of receiving your request. If we have to refuse part of a request, for example because releasing it would breach someone else&#8217;s privacy, we will tell you why and let you know you can complain to the Privacy Commissioner. If we do not agree that information is wrong, you can ask us to attach a statement of the correction you sought, and we will keep that statement with the information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To make a request, email <a href=\"mailto:marketing@quirkycampers.com\">marketing@quirkycampers.com<\/a> with enough detail for us to find the information, and proof of who you are.<\/p>\n\n\n\n<h2 id=\"complaints\" class=\"wp-block-heading\">14. Complaints<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you are unhappy with how we have handled your personal information, please contact our privacy officer first. We will acknowledge your complaint within 5 working days and aim to resolve it within 20 working days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner on 0800 803 909, at <a href=\"mailto:investigations@privacy.org.nz\">investigations@privacy.org.nz<\/a>, or at <a href=\"https:\/\/www.privacy.org.nz\" target=\"_blank\" rel=\"noreferrer noopener\">privacy.org.nz<\/a>. Complaints should usually be made within 12 months of you becoming aware of the issue.<\/p>\n\n\n\n<h2 id=\"changes-to-this-policy\" class=\"wp-block-heading\">15. Changes to this policy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We review this policy at least once a year and update it when our systems or the law change. The version number and effective date at the top show when it last changed.
